Is marijuana legal in the Dominican Republic?

Marijuana is not legal in the Dominican Republic. Cannabis in all its forms — flower, hashish, THC concentrates, THC vapes and edibles — is a controlled substance under Law 50-88 on Narcotic Drugs and Psychotropic Substances. The country has not decriminalised personal possession, does not run a recreational market, and does not currently operate a tourist-accessible medical-cannabis programme. This applies nationwide: Santo Domingo, Punta Cana, Puerto Plata, Samaná, La Romana, Bayahibe and Las Terrenas all enforce the same federal law.

What the law covers

Law 50-88 treats marijuana as a Schedule I-equivalent narcotic alongside cocaine and heroin (though courts treat quantities differently in sentencing). The statute prohibits possession, use, cultivation, sale, transport and import. There is no exemption for personal use, no exemption for tourists, and no exemption for medical prescriptions issued in other countries.

Quantities and sentencing

Simple possession (typically under 20 grams) can be sentenced to 6 months to 2 years and fines; distribution (20 g – 1 kg) to 3–10 years; trafficking (above 1 kg) to 5–30 years. Judges have discretion within these ranges. Most tourist cases are simple-possession charges and resolve with fines, bail and travel restrictions — but the process takes weeks.

Recent reform discussions

The Dominican Congress has periodically discussed medical-cannabis bills since 2017. As of writing, none has passed into operative law. Public opinion polls show majority support for medical use but minority support for recreational legalisation. Tourists should not plan around a hypothetical reform.

DNCD is a federal anti-drug agency with airports, ports, highway checkpoints and tourist-zone units. Punta Cana International Airport (PUJ) and Las Américas (SDQ) are the highest-volume enforcement points for inbound passengers. K9 units and X-ray scanners cover both checked and carry-on luggage. Outbound enforcement also exists, primarily for cocaine but with cannabis included.
